  • The following clauses shall be included in the deed for the sale of the property and shall set forth covenants which are in addition to the existing covenants for the Ross F. Rogers Subdivision: Subdivision: The lot may not be sub-divided. Fences: The Grantee may install fencing on the Lot. However, no fence shall exceed 6 feet in height. All fences shall be in wood, wood composite or metal. Any fence shall be maintained in a proper manner so as not to detract from the value and desirability of surrounding property and such maintenance shall be at the sole cost of the Grantee. Building Size: The maximum above ground area excluding garages and porches and other non-inhabitable space of each dwelling shall not exceed 8,000 square feet. Trees. To protect the urban forest character of the Lot, existing trees and vegetation shall not be removed except for the following purposes (1) to prevent damage or injury to persons or property (ii) to eliminate and control invasive species; and (iii) to eliminate dead or diseased trees. Prior to removal of any tree having a diameter exceeding one foot at a point 4 feet above ground, or trees of any size with an aggregate canopy area of greater than three hundred square feet measured from the dripline of such trees, Grantee shall provide to Grantors a written description k including a map, identifying all trees proposed for removal and the reasons therefore.
